FAQ: Is Bitcoin Gambling Legal in Canada?

This question comes up constantly so figured I'd put together a quick answer.

Short answer: It's a grey area, but Canadian players are not prosecuted for playing at offshore crypto casinos.

Longer answer: The Criminal Code of Canada regulates gambling at the operator level, not the player level. Operating an unlicensed gambling site targeting Canadians is illegal for the operator, but there is no law that makes it illegal for an individual Canadian to place a bet at an offshore site. No Canadian has ever been charged for gambling online at a foreign casino.

The offshore casinos most Canadians use are licensed in jurisdictions like Curaçao or Malta. They operate legally under those jurisdictions' laws even though they accept Canadian customers.

Bitcoin specifically doesn't change the legal picture much. The CRA does require you to report gambling winnings if they constitute a business activity (i.e., you're a professional gambler), but recreational gambling winnings are generally not taxable in Canada.

I would add one nuance: provincial authorities have taken steps to promote their own regulated platforms (such as PlayNow in BC or OLG in Ontario's iGaming market), and Ontario in particular has established a regulated online gambling framework through iGaming Ontario. Players in Ontario have access to locally licensed operators in addition to offshore options. The federal grey area remains, but Ontario's framework provides an additional layer of consumer protection for those who prefer it.
